on the certification procedure for designer's practice in the Republic of Latvia

The Rules prescribe the procedure for granting professional qualification certificates to natural persons for designer's practice in single or several designing spheres. In accordance with the Law of the Republic of Latvia "On Public Organisations and Their Associations", the certificate provides for additional rights in cases prescribed by the laws effective in the Republic of Latvia.

   
1. Definitions.
For the purposes of the present Rules terms are used in the following meaning:
Certificate - a document approving professional qualification of the named designer and his/her ability to conduct projects in single or several designing spheres;
Certified designer - a designer who holds a valid certificate;
Designer's practice:
  1) designing of design objects;
2) preparation of the original design objects;
3) author's supervision;
4) assessment of design objects, analysis and consultations;
5) pedagogical activities in the specific designing sphere;
Designing objects - virtual reality which is designed by the designer
Designing spheres:
- interior and its elements in living, public or production premises and other buildings;
- objects of the environment, their groups or systems, setting up of facilities in the environment and its elements, small-sized forms of architecture, elements of advertising;
- manufactured objects (household appliances, means of transportation, equipment, machinery, devices, etc.);
- graphic design, packaging;
- virtual graphics, Web design;
- fashion design (textile), jewellery products;
- photo design;
- pedagogical activities in the specific designing sphere;
- designing theory, journalism;

2.
Certification Committee.
2.1 The Certification Committee of the LDS (hereinafter in the text - the Committee) shall be constituted by 16 members appointed on two years' term by a closed ballot of the LDS Board.
2.2 The Committee shall appoint its Chairperson and Deputy Chairperson.
2.3 Each meeting of the Committee shall be participated by 8 of its members. The Committee shall be authorised to adopt decisions (except for the decisions specified in Paragraph 3.1 and 3.2) if at least 6 of its members are present at the respective meeting. Decisions shall be adopted in a closed ballot and by simple majority. The Chairperson shall possess the right to have the decisive vote.
2.4 The Chairperson of the Committee shall determine participants of every separate meeting of the Committee depending on the matter to be considered and competence of every member of the Committee.
2.5 Meetings of the Committee shall be organised by the Chairperson of the Committee.
2.6 Upon every meeting the Committee shall submit its minutes to the LDS Board.
2.7 At least twice a year the Committee shall report to the LDS Board on its performance and decisions adopted.
2.8 Implementation of Committee's decisions shall be controlled by the LDS Board.
     
   
   
3.
Competence of the Committee
3.1 The Committee (constituted by all of its 16 elected members) shall appoint its Chairperson and Deputy Chairperson in an open ballot and by simple majority.
3.2 The Committee (constituted by all its 16 elected members) shall approve Regulations, which determine fees for considering of certification applications, granting or renewal of certificates, and for annual prolongation, for examining offences commissioned by certified designers, as well as approve rewarding of members and Chairperson of the Committee. These Regulations shall enter into force upon their approved by the LDS Board.
3.3 The Committee shall present suggestions on granting or renewal of certificates.
3.4 The Committee shall examine professional misconduct of certified designers, compliance with the professional ethics standards and in cases stipulated in Paragraph 6.1 shall decide on:
  - reprimand,
- reprimand in mass media,
- annulment of the certificate.
3.5 If the certificate is annulled, the Committee shall stipulate the requirement to renew the certificate.
3.6 The Committee shall maintain a register of the certified designers.
3.7 The Committee shall inform the public on updates in the register of the certified designers through mass media.
     
   
   
4. Competence of Committee's Chairperson
4.1 The Chairperson shall decide matters relating to preparation and printing of certificates and coordinate the process with the LDS Board.
4.2 The Chairperson shall accept applications on receiving of certificates, their renewal or professional misconduct of certified designers, non-compliance with the professional ethics standards.
4.3 The Chairperson shall determine participants of every separate meeting of the Committee depending on the matter to be considered and professional competence of every member of the Committee.
4.4 In accordance with the present Rules the Chairperson shall determine time of every next meeting of the Committee.
4.5 If necessary, the Chairperson shall invite to meetings of the Committee the following persons:
  - experts,
- designers whose professional qualification or compliance with the professional ethics standards is questioned,
- submitters of complaints and claims.
4.6 The Chairperson shall ensure granting of certificates, their prolongation and entry of the needed data in certificates.
4.7 The Chairperson shall inform submitters of complaints and claims, as well as mass media about the decisions adopted by the Committee.
4.8 The Chairperson shall ensure maintenance of the register of the certified designers.
4.9 In cases when it is impossible for the Chairperson of the Committee to discharge his/her duties, he/she shall be replaced by the Deputy Chairperson of the Committee.
     
   
   
5. Granting of certificates
5.1 The Committee shall grant certificates in order to perform designer's practice in specific designing spheres.
5.2 Certificates shall be granted to designers:
  5.2.1 possessing the respective higher education approved by a diploma issued by a higher education establishment;
5.2.2 lacking the respective higher education but having at least 3-year work experience in the respective designing sphere in Latvia if the materials presented by the applicant approve his/her professional qualification.
5.3 Documents required by the Committee in order to consider application on receiving of certificates:
  5.3.1 the application stating achievement in the respective designing sphere in individual or collective work (also providing assessment of applicant's contribution by other authors of head of the collective);
5.3.2 illustrative materials on works performed in three previous years or other period of time;
5.3.3 a copy of the professional qualification diploma (in case of a special higher or special secondary education);
5.3.4 a document approving payment of the fee for considering of the application.
5.4 The applicant is obliged to participate in the Committee meeting when his/her application is considered only in case he/she receives a prior invitation.
5.5 The designer who is granted a certificate shall pay the fee for granting of such a certificate in order to receive this certificate.
5.6 The certificate shall be granted or a written refusal notice shall be sent not later than within 30 days upon submission of the application.
     
   
   
6. Refusal to grant certificates
6.1. Granting of certificates may be refused by respective reasonable motivation if:
 

6.1.1 activities record of the applicant show non-compliance with the existing professional qualification requirements in the specific designing sphere;
6.1.2 the applicant has violated the professional ethics standard;
6.1.3 the applicant lacks legal capacity and is under guardianship of another person.

6.2. In case of a refusal the applicant shall possess the right to request from the Committee written instructions what requirements have to be met in order to repeatedly apply for receiving such a certificate.
     
   
   
7. Annulment of certificates.
7.1 Matters concerning annulment of certificates shall be decided by the Committee if a motivated written statement is received on non-compliance of a concrete designer with the required professional qualification, on professional misconduct or non-compliance with the professional ethics standards.
7.2 Matters concerning annulment of a certificate shall be considered confidentially and not later than within 30 days upon receipt of the respective statement.
7.3 The Committee may decide on temporary suspension of validity of the certificate, annulment of the certificate or decide on refusal to recognise professional qualification in a sphere named in the certificate; the holder of the certificate shall be informed in writing within 30 days upon adoption of the above-mentioned decision.
7.4 Upon annulment of the certificate or non-recognition of professional qualification in a specific designing sphere the holder of the certificate shall possess the right to apply to the Committee on renewal of the certificate or renewal of a part of it under the general procedure.
     
   
   
8. Validity term of certificates
8.1. Certificates shall be granted for 5 years since the date of the decision. Certificates shall be valid if the prolongation fee is settled every year. The validity terms shall be indicated by a note in the certificate.
8.2 If the annual fee is not settled in due time, validity of the certificate shall be suspended until settlement informing the holder of the certificate about such a decision within 10 days upon its adoption.
8.3 If the annual fee is not settled for more than 3 years (except for the cases caused by parental leave until the age of the child reaches 3 years as provided in the legislation of the Republic of Latvia), the certificate shall be renewed under the requirements stipulated in Paragraph 5.4.1, 5.4.2 and 5.4.4.
     
   
   
9. Certificate fee
Fees for considering of applications, granting of certificates, annual prolongation or renewal shall be determined by the Regulations approved by the Committee. The calculation shall be based on the following costs:
9.1 preparation and printing of certificates;
9.2 considering of applications, granting of certificates and maintenance of the register of the certified designers;
9.3 publication of Committee's decisions in mass media and advertising materials.
     
   
 
10. Appeal against decisions of the Committee
Applicants or holders of certificates may appeal against Committee's decisions to refuse granting, prolongation or renewal of certificates or decisions to annul certificates or their parts to the court under the procedure prescribed by the legislation of the Republic of Latvia.
